Agreement to terms

These Terms of Use ("Terms") govern your access to and use of performesh.ai and the PerforMesh service ("PerforMesh", "the Service"), operated by Abhineer Consulting Private Limited, India. By accessing or using PerforMesh, you agree to these Terms. If you do not agree, do not use the Service.

Who can use PerforMesh

You must be at least 18 years old and authorized to act on behalf of the business you represent to use PerforMesh. By using the Service, you confirm that you meet these requirements.

The service

PerforMesh is an AI customer acquisition service, currently in private beta. It can research your market, draft campaign plans and creative for Google and Meta, create and manage campaigns in the ad accounts you connect after you approve them, show reporting from those accounts, and qualify leads you send to it with scores, suggested next steps, and follow up drafts. Campaigns are created paused, and nothing launches or increases spend without your approval. Sending conversion outcomes back to ad platforms is available but stays off until you turn it on. Features such as automated messaging are not yet available; we will describe them here when they are. Illustrative examples shown in our marketing, such as example lead scores or sample plans, describe how the Service works and are not guarantees of any specific result.

Your account

You are responsible for the accuracy of the information you provide, for maintaining the security of your account credentials, and for all activity that occurs under your account. Tell us right away at hello@performesh.ai if you suspect unauthorized use of your account.

Connected third party accounts

PerforMesh may connect to Google, Meta, your CRM, and other third party platforms at your direction. Your use of those platforms remains subject to their own terms and policies, including Google's advertising policies and Meta's advertising policies. You are responsible for the content, offers, and claims used in campaigns run through your connected accounts, and for your compliance with those platforms' rules.

Autonomy modes and your configuration

Today PerforMesh works in a copilot mode: it researches, drafts, and recommends, and you decide and take every action. More automated modes that act within limits you set are planned. When they are available, you will be responsible for configuring those limits appropriately for your business, and for reviewing recommended and automated actions where your chosen mode calls for review.

Acceptable use

You agree not to use PerforMesh to:

send unlawful, deceptive, or unauthorized communications to leads or customers
violate the rights of others or applicable law, including consent and communication laws that apply to your business
attempt to disrupt, reverse engineer, or gain unauthorized access to the Service
use the Service for a business or purpose we reasonably determine to be high risk or prohibited by our policies or by Google's or Meta's advertising policies

Fees

Fees and billing terms, where applicable, are described separately when you subscribe to a paid plan. We will provide notice before any change that affects the fees you pay.

Intellectual property

PerforMesh and its content, features, and underlying technology are owned by us or our licensors. These Terms do not grant you any rights to our trademarks, logos, or brand assets except as needed to use the Service as intended. You retain ownership of the business, lead, and customer data you provide to PerforMesh.

Disclaimers

The Service is provided "as is" and "as available". PerforMesh researches, recommends, and automates actions using available information and AI, and while we design the Service to be accurate and useful, we do not guarantee specific results, including campaign performance, lead volume, or revenue outcomes. Example scores, plans, and figures shown in our product or marketing are illustrative.

Limitation of liability

To the extent permitted by law, PerforMesh will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose.

Termination

You may stop using PerforMesh at any time. We may suspend or terminate access to the Service if you violate these Terms or if we reasonably believe your use creates risk or legal exposure for PerforMesh, our other customers, or our platform partners.

Changes to these terms

We may update these Terms from time to time. We will post the updated version on this page and update the date at the top. Continued use of the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of [your governing jurisdiction to confirm], without regard to its conflict of law principles.
